Madison County Sheriff Ben Stewart reports that on Friday Nov. 27 at 11:45 p.m. deputies were dispatch to the Waffle House parking lot, located at 145 SE Bandit Street, concerning two subjects engaged in a lewd/lascivious act in the presence of minors. The lewd/lascivious acts were taking place in a 2015 Subaru. Upon arrival, deputies confirmed that Ian Cary Rush, 38, of Twin Lakes, Co., and Frankie Christine Brown, 27, of Pensacola, Fl., were in fact engaged in the reported lewd/lascivious act and placed under arrest. During the investigation, officer(s) detected the odor of marijuana emanating from within the 2015 Subaru the two were occupying. Deputy Dewey deployed Canine Max and obtained a positive alert for the presence of illegal narcotics. A complete search of the vehicle discovered a rubber type tote bag, canvas type tote bag and back pack which contained a variety of packaged marijuana to include marijuana “buds,” powder, seeds, bricks and paraphernalia. The tote bags further contained other personal items and clothing belonging to both Brown and Rush. Rush stated to officers at the scene that he had approximately nine pounds of marijuana that he obtained while in Colorado. However, a complete inventory of the illegal drugs weighed 17.5 pounds. The two are facing charges of lewd/lascivious behavior in the presence of a minor, possession of marijuana with the intent to sell and smuggling marijuana into the state.
